Data Privacy Statement
The Knights of Columbus Fraternal Association of the Philippines, Inc. (“KCFAPI” of the “Association”), is committed in forwarding and protecting the interest of its stakeholders. In compliance to Republic Act No. 10173, also known as the Data Privacy Act of 2012 and its Implementing Rules and Regulation (IRR) and issuances of the National Privacy Commission (NPC), the Association adopts and implements its own Data Privacy Policy which aims to protect individual’s data privacy rights from accidental disclosure or misuse of personal and sensitive information (collectively, “Information”) gathered, processed and stored in the course of business operations.
Consent is at the core of the Association’s data privacy policy. As such, all Information are processed in a manner consistent with the principles of transparency, proportionality and legitimacy of purpose. By providing us with Information, you authorize and consent to the use, processing and transfer of the same. Further, you authorize sharing of said Information to regulatory bodies or government agencies to enable the Association to meet its obligations under applicable laws, regulations including contractual obligations. Likewise, we may further collect or disclose necessary Information to our wholly-owned and majority-owned companies and foundations.
In view of the immediately foregoing, the Association commits in maintaining the integrity, availability and confidentiality of your Information against any incidents or breaches while ensuring the protection of the fundamental right of privacy. Our commitment applies and extends to all our employees, officers and directors of the Knights of Columbus Fraternal Association of the Philippines, Inc. The processing of any Information will only be done when our stakeholders consent prior to collection of data or as soon as practicable and reasonable.
The Association will protect the privacy of Information through implementation of organizational, technical, operational and security measures against unauthorized or unlawful use, loss, alteration, destruction, sharing, or access to the Information which are transmitted, stored, or otherwise processed. Any transfer or sharing or outsourcing of any processed information will be done through an agreement in compliance to existing laws of the Republic of the Philippines.
Your Rights as Data Subjects
As a data subject, you are entitled to exercise the following minimum rights under existing laws and regulations:
- RIGHT TO BE INFORMED – Every client has a right to be informed whether personal data pertaining to him shall be, are being, or have been processed, including the existence of automated decision-making and profiling. Clients and other stakeholders are notified and furnished with the Information provided by law before the entry of his or her personal data into the processing system of the Association or at the next practical opportunity.
- RIGHT TO OBJECT – Corollary to one’s right to be informed of any processing is the right to object to the processing of his Information, automated processing, or profiling. One must be notified and given an opportunity to withhold consent in case of changes to the Information, unless required under the law or as a legal obligation. In case of the exercise of this right, the Association shall no longer process the data unless it is one of the circumstances indicated by law or only up to the extent agreed upon.
- RIGHT TO ACCESS – All stakeholders whose information are processed have a right to reasonable access to, upon demand, on the following Information: Contents of the Information that are processed; sources from which the personal data were obtained; names and addresses of recipients of the personal data, manner by which such data were processed; reasons for the disclosure of the personal data to recipients, if any; information on any automated processes where data will or is likely to be made as sole basis for any decision that significantly affects or will affect the client; date when personal data concerning client were last accessed and modified; and the Associations’ identity and address.
- RIGHT TO DISPUTE – Stakeholders have the right to dispute the accuracy in the personal data or Information within the Association’s control and have it corrected accordingly, unless said request would contravene any laws or would otherwise be unreasonable.
- RIGHT TO DESTRUCTION – The client has the right to suspend, withdraw or order the blocking, removal or destruction of his or her personal data from the Association’s filing system upon the conditions declared by law.
Your Personal Data
Our commitment to your data privacy and security is of paramount importance as you avail of our products and services. Thus, we want to make it clear that personal information obtained in transacting with our agents and representatives will only be used in a manner consistent in protecting your privacy. However, our commitment to confidentiality only extends up to what had been agreed upon with our stakeholders or as required by Philippine law.
Information Disclosure
We do not share personal information with entities and/or individuals outside of KCFAPI group but subject to the provisions applicable to the Philippine law, personal information, the Association may among others be:
- Shared to the duly authorized representatives of the Association in the fulfillment of its business objectives;
- Made available to any of the Association’s wholly-owned and majority-owned companies and foundations for any valid legal or business purposes;
- Supplied with your consent to persons you have authorized in writing;
- Disclosed to any government or appropriate regulatory authorities; and/or
We have good-faith in the processing and/or disclosure of the information necessary to comply with laws or regulations or for the purpose of the Association’s legitimate interest.
Retention
The Association commits itself to not keeping personal data or Information longer than is necessary of the fulfillment of the purpose for which the data is collected or is to be used.
Personal Information shall be retained by the Knights of Columbus Fraternal Association of the Philippines Inc., for as long as the same is required to meet its obligations and comply with applicable legal requirements, or other standards set out by a governing body. The information shall be retained only for as long as necessary and within a definite period until it is destroyed, disposed, or anonymized, unless the same cannot be allowed by any written or express authority.
Security
The Association applies strict measures to safeguard the confidentiality of personal data and limit access to your personal data to people working for the Association, only on a need-to-know basis, in the fulfillment of your transaction with us and in the performance of our obligations to stakeholders to ensure that your personal data are protected against unauthorized or accidental access, processing, erasure, loss or use.
Data Breaches
The Association values the trust and relations with its clients and stakeholders. Hence, we will ensure to address all personal data breaches in relation to data subjects whose Personal information are held, processed, retained or shared by the Knights of Columbus Fraternal Association of the Philippines, Inc. The standards for breach management that we implement are guided by Philippine laws and regulations. If you have information or have reason to believe that your Information was unlawfully obtained, shared, disclosed, or used for unauthorized purposes, you may contact the Data Privacy Officer.
Data Privacy Officer (DPO)
The Knights of Columbus Fraternal Association of the Philippines Inc.’s DPO ensures that the Association meets its requirements and obligations under the applicable data privacy laws, rules, and regulations. Any complaints or breaches must be communicated directly to the DPO.
